PART 1: SMS TERMS OF SERVICE

1.1  Program Description

Hidden Talents ABA (‘we,’ ‘us,’ or ‘our’) operates an SMS messaging program to support communication with families, caregivers, and authorized representatives (‘you’) regarding ABA therapy services. Messages may be sent from short codes or 10-digit long codes (10DLC) registered to Hidden Talents ABA.

1.2  Message Types

By opting into our SMS program, you may receive the following types of messages:

  1. Appointment scheduling, reminders, confirmations, and cancellations

  2. Insurance authorization status and updates

  3. Intake coordination and onboarding instructions

  4. Therapy session updates and care team notifications

  5. Billing reminders and administrative notices

  6. Responses to inquiries submitted through our website or by phone

1.3  Message Frequency

Message frequency varies depending on your therapy schedule and the nature of your communications with our team. You may receive multiple messages per week during active care coordination. For general inquiry responses, messages are sent as needed.

1.4  Message & Data Rates

Message and data rates may apply. Charges are determined by your mobile carrier. Hidden Talents ABA does not charge for SMS messages. Contact your mobile carrier for information about your plan’s messaging rates.

1.5  Opting Out

You may opt out of SMS communications at any time. To stop receiving messages:

  1. Reply STOP to any message from Hidden Talents ABA

  2. Contact us at 404-487-6005 or info@hiddentalentsaba.com to request removal

After replying STOP, you will receive one final confirmation message. No further messages will be sent unless you re-enroll. Opting out of SMS does not affect your ability to receive services from Hidden Talents ABA.

1.7  Supported Carriers

Our SMS program is supported by all major U.S. wireless carriers including AT&T, Verizon, T-Mobile, Sprint, U.S. Cellular, Boost Mobile, MetroPCS, and others. Carrier participation may vary. Hidden Talents ABA is not responsible for undelivered messages due to carrier limitations.

1.8  Consent Is Not a Condition of Service

Providing your mobile phone number and consenting to receive SMS messages is entirely voluntary. You are not required to consent to receive SMS messages as a condition of receiving ABA therapy services or any other services from Hidden Talents ABA.

1.9  Modifications to This Policy

Hidden Talents ABA reserves the right to modify these SMS Terms of Service at any time. Updated terms will be posted at hiddentalentsaba.com/sms-terms. Continued use of SMS communications following notice of changes constitutes acceptance of the updated terms.


PART 2: SMS PRIVACY POLICY

This SMS Privacy Policy describes how Hidden Talents ABA collects, uses, and protects personal information gathered through our SMS communications program. This policy supplements our general Privacy Policy available at hiddentalentsaba.com and applies specifically to our text messaging program.

2.1  Information We Collect

When you opt into our SMS program, we collect:

  1. Your mobile phone number

  2. Your name and relationship to the patient/client

  3. Opt-in date, time, and method (e.g., web form, verbal consent, written consent)

  4. Message history for quality assurance and compliance purposes

2.3  No Sharing of Mobile Numbers for Marketing

We will not use your mobile phone number to send you marketing messages from third-party businesses. Any third-party partners who assist us in delivering SMS messages (such as our SMS platform provider) are contractually bound to use your information only as directed by Hidden Talents ABA and are prohibited from using it for their own marketing purposes.

We may share your information with third-party service providers who assist us in operating our SMS program, including messaging platform vendors and technology providers. These providers are limited to using your information to perform services on our behalf and are required to maintain appropriate confidentiality and security standards.

Hidden Talents ABA is a healthcare provider subject to the Health Insurance Portability and Accountability Act (HIPAA). To the extent that any SMS communication may involve Protected Health Information (PHI), we handle such information in accordance with our HIPAA Notice of Privacy Practices. Standard SMS is not an encrypted channel. We recommend that you do not send sensitive health information via text message. 2.6  Data Retention

We retain SMS consent records and communication logs for a minimum of four (4) years or as required by applicable law, including healthcare regulations. Opt-out requests are honored immediately and retained as permanent records to prevent inadvertent re-enrollment.

2.7  Security

Hidden Talents ABA implements reasonable administrative, technical, and physical security measures to protect your information. However, no method of transmission over the internet or mobile network is 100% secure. We encourage you not to share sensitive personal health information via text message.

2.8  Children’s Privacy

Our SMS program is directed at parents, legal guardians, and authorized representatives of minor clients receiving ABA therapy services. We do not knowingly collect mobile numbers directly from individuals under the age of 18. If you are a minor, please have your parent or legal guardian provide consent on your behalf.

2.9  Your Rights

You have the right to:
